Healthy Kidz – Programme Terms & Conditions and Health & Safety Waiver
(Applicable to PE Delivery, After-School Sessions, Holiday Camps, Special Events and Colour Runs)
1. Introduction
These Terms and Conditions govern participation in all Healthy Kidz programmes, including PE sessions, after-school activities, holiday camps, special events and colour runs. By registering a child (“the Participant”), the parent or legal guardian (“the Parent/Guardian”) confirms acceptance of these Terms and Conditions and agrees to be bound by them. Healthy Kidz reserves the right to amend these Terms from time to time, with notice provided in advance of any changes.
2. Behaviour and Conduct
Healthy Kidz promotes a safe, respectful and positive environment. Bullying, harassment, violence or any behaviour that endangers others is strictly prohibited. Healthy Kidz may remove a Participant immediately for serious misconduct or withdraw a Participant for repeated behavioural issues. No refund will be issued where removal is due to behaviour. Healthy Kidz staff will address incidents promptly and communicate with the Parent/Guardian where necessary.
3. Attendance, Participation and Fitness to Take Part
The Parent/Guardian is responsible for ensuring punctual drop-off and collection. Healthy Kidz may impose charges for late collection. The Parent/Guardian must ensure the Participant is fit, well and able to safely engage in physical activity. Healthy Kidz may refuse participation if the Participant appears unwell, injured or otherwise unable to take part safely. Absences should be communicated as early as possible.
4. Medical Conditions, Allergies and Additional Needs
The Parent/Guardian must disclose all medical conditions, allergies (including nut allergies), behavioural needs, developmental needs or any requirement for one-to-one support at the time of booking. This includes asthma, epilepsy, physical limitations, emotional or behavioural needs, or any condition that may affect safe participation.
Healthy Kidz will make reasonable adjustments where possible; however, where a Participant requires support beyond standard staffing ratios, Healthy Kidz may require a Parent/Guardian or support assistant to attend. Healthy Kidz may decline or withdraw a place if the Participant’s needs cannot be safely accommodated. Failure to disclose relevant information may result in removal without refund.
Packed lunches must not contain nut-based products.
5. Safety, Supervision and Duty of Care
Healthy Kidz provides trained staff and follows established safeguarding, supervision and risk assessment procedures. Participants must follow all instructions issued by Healthy Kidz staff. Healthy Kidz may modify or cancel activities for safety or operational reasons. Healthy Kidz accepts no responsibility for loss or damage to personal belongings brought to the programme.
6. Equipment and Facilities
Children must respect the equipment and facilities provided. Parents may be held responsible for any damage caused by intentional misuse. Healthy Kidz cannot accept responsibility for loss or damage to personal belongings brought to the programme.
7. Communication, Complaints and Incident Reporting
Healthy Kidz will communicate promptly regarding incidents, concerns or injuries involving the Participant. The Parent/Guardian may contact programme staff or email coaching@healthy-kidz.com with any questions or complaints.
8. Payment, Cancellations and Refunds
Full payment is required at the time of booking. Refunds or credits may be issued where Healthy Kidz is informed in advance and where the space can be offered to another participant. Refunds will not be issued for illness on the day, school trips or events, personal commitments, or any absence outside Healthy Kidz’s control.
Where a whole-school closure affects delivery, Healthy Kidz will provide an additional session or issue a credit or discount code. Healthy Kidz may cancel or amend sessions for safety, staffing or operational reasons; alternative sessions or credits will be offered.
9. Photography and Media
Consent for photography or video will be requested separately. Where consent is withheld, Healthy Kidz will take reasonable steps to exclude the Participant from media capture.
10. Health & Safety Waiver and Assumption of Risk
10.1 Assumption of Risk
The Parent/Guardian acknowledges that participation in physical activity carries inherent risks, including slips, trips, falls, collisions, muscle strains, exposure to weather conditions, and contact with coloured powder during colour run events. By registering the Participant, the Parent/Guardian voluntarily assumes all such risks.
10.2 Medical Fitness
The Parent/Guardian confirms that the Participant is medically fit to participate and that all relevant medical information has been disclosed. Required medication (such as inhalers or EpiPens) must be provided. Healthy Kidz may refuse participation if medical fitness is in doubt.
10.3 Colour Run Waiver
For colour run events, the Parent/Guardian acknowledges that coloured powder may come into contact with skin, hair, eyes and clothing, may cause temporary irritation, and may pose increased risk to individuals with respiratory conditions. Protective eyewear is recommended. Clothing may become stained. Healthy Kidz will take reasonable precautions but cannot eliminate all risks associated with coloured powder.
10.4 Liability Waiver
To the fullest extent permitted by law, Healthy Kidz shall not be liable for accidental injury arising from participation, minor injuries inherent to physical activity, aggravation of undisclosed medical conditions, or damage to personal property. This waiver does not exclude liability for negligence, breach of statutory duty, or any liability that cannot legally be excluded under Northern Ireland law.
10.5 Indemnity
The Parent/Guardian agrees to indemnify Healthy Kidz against claims arising from failure to disclose medical or behavioural information, failure to provide required medication, behavioural incidents caused by the Participant, or breach of these Terms and Conditions.
11. Programme Variations and Weather
Healthy Kidz may alter activities due to weather, safety concerns or operational requirements. No refund will be issued where activities are modified for safety reasons.
12. Data Protection
Healthy Kidz processes personal data in accordance with GDPR and the Data Protection Act 2018. A full Privacy Notice is available upon request.
13. Governing Law
These Terms and Conditions are governed by the laws of Northern Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
14. Final Agreement
By completing registration, the Parent/Guardian confirms that they have read, understood and agree to these Terms and Conditions, including the Health & Safety Waiver and Assumption of Risk, and understand that failure to comply may result in removal without refund.
